Terms of Service

These terms govern your use of Haulout (“Haulout,” “we,” “us”). By creating an account or using the service you agree to them and to our Privacy Policy.

The service

Haulout is a marketplace that helps yacht brokers find marine surveyors and helps buyers compare surveyor proposals. Haulout is not a party to any agreement between brokers, surveyors, and buyers, does not perform surveys, and does not guarantee the quality, timing, or outcome of any survey. Surveyors are independent professionals. Verification on Haulout reflects an administrative review and is not an endorsement or guarantee.

Accounts

• You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.
• Surveyor accounts are reviewed before they can use the platform. We may suspend or remove any account that violates these terms or harms the platform or its users.

Your content and your responsibilities

• Brokers represent that they have the right to submit the vessel and buyer information they enter, and that the buyer has agreed to be contacted by email and text message about the survey.
• Surveyors are responsible for the accuracy of their proposals, credentials, and reports, and for holding any licenses and insurance their work requires.
• Completed survey reports are shared between the surveyor and the buyer. Brokers are notified when a survey is completed but are not given access to the report through Haulout.
• You may not use Haulout to send unlawful, misleading, harassing, or spam content, to interfere with the service, or to collect other users’ information for unrelated purposes.

Fees

Haulout is currently free to join. Any rates or fees for a survey are agreed between the surveyor and buyer. If we introduce fees for the platform, we will tell you in advance.

Text Messaging Terms

These terms apply to text messages sent by Haulout (the “Haulout Notifications” program).

• Program description: Haulout sends account and service notifications by text message, such as new survey requests in your area, new surveyor proposals, surveyor selection confirmations, scheduling updates, and survey completion notices. These messages are not marketing or promotional messages.
• How you opt in: Brokers and surveyors opt in by adding their mobile number to their profile and turning on “SMS notifications.” Buyers receive texts about their survey at the mobile number the requesting broker provided, and the broker confirms the buyer has agreed to receive them.
• Message frequency: varies with your activity on Haulout.
• Cost: message and data rates may apply, depending on your mobile plan.
• Opt out: reply STOP to any message to stop receiving texts. You can also turn off SMS notifications in your profile. After you opt out we may send one final message confirming it.
• Help: reply HELP to any message, or email support@gethaulout.com.
• Carriers: carriers and wireless providers are not liable for delayed or undelivered messages.
• Consent: consent to receive texts is not a condition of purchasing anything or using Haulout, although opting out means you will not receive text notifications.
• Privacy: see our Privacy Policy. No mobile information is shared with third parties or affiliates for marketing or promotional purposes.

Disclaimers

Haulout is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, Haulout will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the service or from any survey, transaction, or dispute between users. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid Haulout in the twelve months before the claim or $100.

Termination

You may stop using Haulout and ask us to close your account at any time. We may suspend or terminate access if you violate these terms. Provisions that by their nature should survive termination will survive.

Changes to these terms

We may update these terms from time to time and will post the updated version here with a new date. Continued use of Haulout after a change means you accept the updated terms.
